"The Information Commissioner’s Office (ICO) will be able to order organisations to pay up to £500,000 as a penalty for serious breaches of the Data Protection Act," said an ICO statement. "The ICO has produced statutory guidance about how it proposes to use this new power, which has been approved by the Secretary of State for Justice, and has been laid before Parliament today."
This was the statement made in the press after legislation was passed on the 6th April 2010. It follows well publicised instances in the media which has involved the loss of laptops, mobile phones, CD-ROMs and removable storage devices on which entire data bases of sensitive information, including bank details, medical information and other personal information was listed and open to abuse.
The legislation is not to stop the use of such technology, but more to ensure that organisations take correct and responsible steps to ensure that if these devices are used the data on them is controlled, encrypted and protected.
These devices exist everywhere and, with the amount of USB attachable devices growing exponentially, it is vital that an organisation understands how it can mitigate against the risk that these devices can inadvertently facilitate.
